The following terms and conditions relate to the use of all ENTERTAINMENT INDUSTRY TRAINING (ABN 6353 0647 853) products and services currently being offered and those introduced to the market in the future.

Please note:
In these terms and conditions, “you” refers to any school, RTO, TAFE, University, individual or entity, who has purchased an ENTERTAINMENT INDUSTRY TRAINING product or service for teaching or training purposes. It does not include any affiliates or other educational entities or institutions that may be connected or affiliated to you.

Product Usage
Any products purchased under a licence are to be used in accordance with the licence agreement as outlined on this website.
You confirm that all details supplied by you when you made the purchase are accurate and complete.
Copyright Statement
ENTERTAINMENT INDUSTRY TRAINING owns all Copyright on its products as detailed in the Copyright Act 1968. You may not partially or totally reproduce these materials without prior written permission from ENTERTAINMENT INDUSTRY TRAINING. This means you may not:

Remove any copyright, trademark and propriety notices.

photocopy the whole of, or any portion of these materials outside of the licence agreements

alter them to include with your own written materials

make modifications to the materials

publish, scan or upload them to file sharing internet sites without prior agreement or acceptable security provisions in place

download any product for any purpose which is illegal or prohibited; violates our rights in any way; or is prohibited by the general terms and conditions.

Use the content for commercial purposes other than what is permitted in the licence agreements.

ENTERTAINMENT INDUSTRY TRAINING will periodically conduct checks of organisations suspected of breaching the copyright statement. Identified breaches will result in prosecution.

ENTERTAINMENT INDUSTRY TRAINING products are sold for teaching and training purposes only and not for resale.
Ownership Rights

All rights, title, and interest in and to the ENTERTAINMENT INDUSTRY TRAINING products, all components thereof and material therein, any updates and copies of the same, are owned exclusively by ENTERTAINMENT INDUSTRY TRAINING, or ENTERTAINMENT INDUSTRY TRAINING’s licensors, together with all intellectual property rights in all of the foregoing (including but not limited to copyright, trademarks, database rights, designs and design rights, patents, inventions, know-how, trade secrets, and all other similar rights arising under the laws of any jurisdiction whether registered or unregistered and including any applications to register the same).

ENTERTAINMENT INDUSTRY TRAINING owns any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to the ENTERTAINMENT INDUSTRY TRAINING products or services.
Except by agreement, you do not have, and are not granted, any right, title or interest in or to any ENTERTAINMENT INDUSTRY TRAINING products or services.
No Warranty
ENTERTAINMENT INDUSTRY TRAINING has made every effort to ensure the accuracy of all information provided as well as to meet all training requirements and does not take responsibility for any errors or omissions. The information and materials contained in the resources are provided “as is”. ENTERTAINMENT INDUSTRY TRAINING does not warrant the accuracy, adequacy or completeness of this information and materials and expressly disclaims liability for errors or omissions in this information and materials.
You must take your own precautions to ensure that the download process employed by you to access the products does not expose you to the risk of viruses, malicious computer code or other forms of interference, which may damage your own computer system. ENTERTAINMENT INDUSTRY TRAINING does not accept responsibility for any interference or damage to your own computer system or data, which arises in connection with the downloading of products.

PLEASE NOTE THAT WE ARE NOT LIABLE FOR ANY DAMAGES, INCLUDING:

DAMAGES INTENDED TO COMPENSATE SOMEONE DIRECTLY FOR A LOSS OR INJURY

DAMAGES REASONABLY EXPECTED TO RESULT FROM A LOSS OR INJURY (KNOWN IN LEGAL TERMS AS “CONSEQUENTIAL DAMAGES.”)

OTHER MISCELLANEOUS DAMAGES AND EXPENSES RESULTING DIRECTLY FROM A LOSS OR INJURY (KNOWN IN LEGAL TERMS AS “INCIDENTAL DAMAGES.”)

WE ARE NOT LIABLE EVEN IF WE’VE BEEN NEGLIGENT OR IF OUR AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR BOTH. EXCEPTION: CERTAIN STATE LAWS MAY NOT ALLOW US TO LIMIT OR EXCLUDE LIABILITY FOR THESE “INCIDENTAL” OR “CONSEQUENTIAL” DAMAGES. IF YOU LIVE IN ONE OF THOSE STATES, THE ABOVE LIMITATION OBVIOUSLY WOULD NOT APPLY WHICH WOULD MEAN THAT YOU MIGHT HAVE THE RIGHT TO RECOVER THESE TYPES OF DAMAGES.
HOWEVER, IN ANY EVENT, OUR LIABILITY TO YOU FOR ALL LOSSES, DAMAGES, INJURIES, AND CLAIMS OF ANY AND EVERY KIND (WHETHER THE DAMAGES ARE CLAIMED UNDER THE TERMS OF A CONTRACT, OR CLAIMED TO BE CAUSED BY NEGLIGENCE OR OTHER WRONGFUL CONDUCT, OR THEY’RE CLAIMED UNDER ANY OTHER LEGAL THEORY) WILL NOT BE GREATER THAN THE AMOUNT YOU PAID IF ANYTHING TO ACCESS OUR SITE.
Teacher Challenge and Marking Service
The Teacher Exam Challenge and Marking Service are offered to schools and teachers as a way on receiving feedback on their performance in the examination only. All due care will be taken in the process of running and educating both services to provide a fair outcome for all involved. Refer to the No Warranty section above for information about liability.

The Teacher Challenge is not offered to students and can only be completed by teachers and staff of NSW schools.

Nominated teachers will be vetted before the commencement of their participation to ensure the legitimacy of participation.

Schools and/or Teachers must order the 2024 Trial HSC examination or the Complete 2024 package which includes the Trial examination as a condition of entry for the event. Schools or Teachers who have not ordered the exam for their school will be disqualified from participating in the event.

Participants are expected to act with honesty for the duration of the event, including the highest ethical behaviour pre-event, during the exam, and in delivering the examination without alteration for the examiner to grade.

Participants must abide by the security periods and conditions of the exam.

By participating in the Teacher Challenge or Marking Service, participants, schools and their sector agree to the publishers use of their written answers being used commercially, without identifying the participant or their school. Generally these may be used as sample, benchmark, or example answers for Examination workshops.

The Marking Service is only offered for marking of the Entertainment Industry Training created examinations, and not those produced by other companies or schools.

ENTERTAINMENT INDUSTRY TRAINING reserves the right to vary or amend these conditions at any time.
